1 The tussle between lenders and their borrowers is an old one. It is noted in the new covenant of the Bible[2], in literature of the middle ages and it rages on to this day almost unabated. In Kenya, there are two statutes that regulate banking namely the Central Bank of Kenya [3] (hereinafter the “CBK Act”) the Banking Act [4](hereinafter the Act).
